Terms & Conditions

By booking with Treki Travels, you unconditionally agree to all terms set forth herein.

CLAUSE 1 — DEFINITIONS

"Treki" or "Company" means Treki Travels, a travel and tourism enterprise. "Participant" means any individual who books, registers, pays, or travels on a Treki trip, including any person on whose behalf a booking is made. "Trip" includes treks, yatras, pilgrimages, tours, and all packages offered by Treki. "Booking" means any confirmed reservation effected through advance payment, WhatsApp confirmation, website form submission, or email — any of which constitutes a binding acceptance. "Third-Party Provider" means any hotel, homestay, transport operator, guide, porter, or vendor engaged by Treki to deliver ground services. "Force Majeure" means any event beyond Treki's reasonable control, including but not limited to adverse weather, landslides, floods, earthquakes, avalanches, government orders, SDRF/NDRF restrictions, road closures, pandemics, epidemics, strikes, civil unrest, or acts of God.

CLAUSE 2 — ELIGIBILITY

Participants must be 18 years of age or older to enter into a booking independently. Participants below 18 years must travel accompanied by a parent or legal guardian who expressly accepts full legal responsibility for the minor under these Terms. By completing a booking, the Participant confirms they are legally competent to enter into a binding contract under the Indian Contract Act, 1872. Treki reserves the right to refuse or cancel a booking if eligibility conditions are not met, without liability or refund obligation.

CLAUSE 3 — BOOKING & PAYMENT

A Participant's seat is confirmed exclusively upon receipt of the advance booking amount specified at the time of enquiry. Full payment of the trip cost must be completed prior to trip commencement. All prices are quoted in Indian Rupees (INR). GST at 5% (or as applicable under law) is chargeable in addition to the quoted price unless explicitly stated otherwise. Any payment made via UPI, bank transfer, or any digital mode, or any written confirmation via WhatsApp or email, constitutes binding acceptance of these Terms and is enforceable under Section 10A of the Information Technology Act, 2000. Prices confirmed at the time of booking shall not be revised to the Participant's detriment after booking confirmation. Treki reserves the right to revise prices for future bookings without prior notice.

CLAUSE 4 — CANCELLATION & REFUND

The advance booking amount is strictly non-refundable under all circumstances, without exception. Treki pre-commits to costs including accommodation, transport, permits, guide fees, and vendor deposits well in advance. These costs are non-recoverable upon cancellation.

Cancellation requests must be submitted exclusively in writing via WhatsApp (+91 6375372499) or email (hello@trekitravels.com). Verbal cancellations shall not be entertained. Refunds processed within 7–14 working days.

CLAUSE 5 — DATE CHANGE

One date change per booking is permitted, subject to written request received no fewer than 30 days prior to original departure. A date change fee of ₹500 per person applies, plus any price differential. Requests within 30 days of departure are treated as cancellation under Clause 4. All date changes subject to availability. Treki's decision on availability is final.

CLAUSE 6 — NO GUARANTEE OF CONDITIONS

Treki provides no guarantee regarding weather, snow, visibility, mountain views, darshan access, road accessibility, or wildlife sightings. All photographs, videos, and marketing materials are representative only and do not constitute a guarantee of experience. Variation from marketing representations shall not give rise to any refund, compensation, or claim.

CLAUSE 7 — ITINERARY MODIFICATION & FORCE MAJEURE

Treki reserves the right to alter, modify, or substitute any element of the published itinerary — including route, campsites, accommodation, transport, schedule, or destination — at any time for safety or operational reasons. No refund or compensation for such modifications.

Service Dependency Clause: All trips are subject to weather, road accessibility, forest permits, SDRF/NDRF guidelines, and local authority orders. Treki does not warrant execution of any trip in its published form.

In Force Majeure situations, Treki will offer reschedule or partial credit. No cash refund shall be claimable.

"In government-imposed closures including SDRF restrictions at Kedarnath, all incidental costs are borne solely by the Participant."

Unforeseen Expense Clause: Any additional expenses from weather delays, route diversions, extended stays, or road blockages shall be borne entirely by the Participant. Treki shall not be liable for such costs.

CLAUSE 8 — ARRIVAL & PUNCTUALITY

Participants must report at the designated pickup point at the communicated time. Treki is not liable for missed transport or trip commencement due to late arrival. No refund in such cases.

CLAUSE 9 — TRANSPORT

All transport is arranged through licensed third-party operators. Treki is not the carrier or vehicle operator. Treki is not liable for delays, breakdowns, accidents, or incidents involving third-party vehicles. Under the Motor Vehicles Act, 1988, liability for accidents rests with the vehicle owner and their insurer. Participants are advised to hold personal travel and accident insurance.

CLAUSE 10 — ACCOMMODATION

Accommodation is on sharing basis as per package specification. Treki may substitute designated accommodation with equivalent alternative without prior notice. No refund for such substitutions.

CLAUSE 11 — PERSONAL BELONGINGS

Participants are solely responsible for safekeeping of luggage, equipment, and valuables throughout the trip. Treki, its staff, and partners accept no liability for loss, theft, or damage to personal belongings at any point during the trip.

CLAUSE 12 — HEALTH, FITNESS & MEDICAL DISCLOSURE

By booking, the Participant confirms they are in adequate physical and mental health. All pre-existing conditions, medications, allergies, and physical limitations must be disclosed in writing before departure. Concealment of medical information releases Treki from all consequent liability. Participants must carry personal medications — Treki does not provide these. The Participant confirms they are not travelling against medical advice.

"The trek leader's decisions regarding fitness — including mandatory descent — are final and binding. No refund in such cases."

CLAUSE 13 — EMERGENCY & EVACUATION

Many destinations have limited or no access to medical facilities, mobile networks, or emergency services. Emergency evacuation is not guaranteed and depends on terrain, weather, and available resources. Treki will make reasonable efforts to assist but does not guarantee evacuation speed or success. All costs for emergency treatment, evacuation, and rescue are entirely the Participant's responsibility.

CLAUSE 14 — TRAVEL INSURANCE

Travel, medical, and evacuation insurance is NOT included unless explicitly confirmed in writing. Treki strongly advises every Participant to procure comprehensive insurance before departure covering: personal accident, medical treatment, high-altitude evacuation, trip cancellation, and baggage loss. All such costs are entirely the Participant's responsibility. Treki bears no liability for losses recoverable under adequate insurance.

CLAUSE 15 — PARTICIPANT CONDUCT

Participants must conduct themselves with respect toward all fellow travellers, trek leaders, guides, staff, and locals. Treki reserves the right to remove any Participant without refund for: harassment or abusive behaviour; use or possession of illegal substances; non-compliance with trek leader instructions; conduct compromising safety of others.

"Right of Removal: Treki reserves the unilateral right to cancel a booking or remove a Participant mid-trip at its sole discretion. No refund shall be due and Treki bears no liability for onward expenses of removed Participants."

CLAUSE 16 — THIRD-PARTY SERVICES

Treki operates as a travel organiser and service facilitator, curating services from independent third-party providers. Where Treki is not the direct provider, the contractual relationship exists between the Participant and the respective provider. Treki exercises due diligence in partner selection but is not responsible for any act, omission, or deficiency of any third-party provider.

CLAUSE 17 — LIMITATION OF LIABILITY

Treki's maximum liability to any Participant shall not exceed the total booking amount paid for that trip. Treki is not liable for indirect, consequential, or special losses including loss of enjoyment, emotional distress, or loss of income. Nothing in these Terms excludes Treki's liability for death or personal injury caused by proven gross negligence directly attributable to Treki.

CLAUSE 18 — ASSUMPTION OF RISK & INDEMNITY

The Participant acknowledges that trekking, adventure tourism, and pilgrimage travel involve inherent risks including: Acute Mountain Sickness (AMS), High-Altitude Cerebral Edema (HACE), High-Altitude Pulmonary Edema (HAPE), physical injury, illness, extreme weather, flash floods, landslides, rockfall, vehicle incidents, and in rare but foreseeable circumstances, permanent disability or death.

The Participant voluntarily participates with full awareness of these risks. If incapacitated, the Participant authorises Treki and the trek leader to make emergency decisions on their behalf — all costs borne by the Participant.

The Participant fully and irrevocably releases Treki, its employees, trek leaders, and partners from all claims arising from participation, except in cases of proven gross negligence by Treki. The Participant agrees to indemnify Treki against all claims arising from their own actions, negligence, or failure to disclose medical information. This release and indemnity is binding upon the Participant's heirs and legal representatives.

CLAUSE 19 — PHOTOGRAPHY & CONTENT

Treki may photograph and video Participants during trips for marketing and archival use. By booking, the Participant grants Treki a non-exclusive, royalty-free, perpetual licence to use such content. By tagging @trekitravels on social media, the Participant grants permission to reshare. To opt out, notify Treki in writing before trip commencement.

CLAUSE 20 — DATA PRIVACY (DPDP ACT 2023)

Treki collects personal data including name, contact details, government ID, and medical information for trip operations and compliance. All processing is under the Digital Personal Data Protection Act, 2023. Data is not sold or shared except as required for trip execution or law. To access, correct, or delete data, email hello@trekitravels.com — processed within 30 days.

CLAUSE 21 — GRIEVANCE REDRESSAL

Complaints must be submitted in writing within 15 days of trip conclusion via hello@trekitravels.com or WhatsApp +91 6375372499. Treki acknowledges within 3 working days and resolves within 15 working days. Treki is not liable for grievances arising from Force Majeure or third-party service failures.

CLAUSE 22 — DISPUTE RESOLUTION

Disputes shall first be resolved through good-faith negotiation within 30 days. If unresolved, binding arbitration under the Arbitration and Conciliation Act, 1996 applies. Seat: Jaipur, Rajasthan, India. Language: English or Hindi. The arbitrator's award is final and binding. Subject to above, courts at Jaipur, Rajasthan have exclusive jurisdiction.

CLAUSE 23 — GENERAL PROVISIONS

Written Communication Clause: Only written communication via WhatsApp (+91 6375372499) or email (hello@trekitravels.com) constitutes valid binding communication. No verbal representation or telephonic assurance by any Treki representative is binding. Participants should obtain all confirmations in writing.

These Terms supersede all prior communications. The version in effect at date of booking governs that booking. If any provision is found invalid, remaining provisions continue in full force. Latest version always at trekitravels.com/terms.

"By booking with Treki Travels — whether through advance payment, WhatsApp confirmation, website form submission, or any written communication — the Participant confirms they have read, understood, and unconditionally agreed to all 23 clauses of these Terms and Conditions. This agreement is legally binding under the Indian Contract Act, 1872, and enforceable under Section 10A of the Information Technology Act, 2000."
